Refund Policy

1. Overview
At Ata Games (Ganduja Interactive OÜ), we value customer satisfaction. However, as products sold on the Platform are digital, non-tangible goods, our refund policy includes specific provisions within the framework of European Union consumer law.
2. Payments and Merchant of Record
All payments on the Platform are processed by Lemon Squeezy as the Merchant of Record. Lemon Squeezy handles billing, taxes, and compliance on behalf of Ganduja Interactive OÜ. Accordingly, refund requests are primarily processed through the Lemon Squeezy infrastructure.
3. Digital Products and Waiver of Right of Withdrawal
Important Legal Notice: All products sold on the Platform are digital content. Pursuant to Article 16(m) of EU Directive 2011/83/EU on Consumer Rights, once delivery of digital content begins with the consumer's express consent, the consumer is deemed to have waived the 14-day statutory right of withdrawal.
By checking the "I agree to immediate download and waive my right of withdrawal" checkbox during purchase, this waiver takes effect and your statutory refund right may no longer apply.
4. Our Discretionary Refund Policy (Steam Model)
Although not legally required, we offer discretionary refund evaluation under the following conditions for customer satisfaction:
- For games: A refund request is considered if made within 14 days of purchase AND the game has been played for less than 2 hours.
- Early Access games: The same rule applies; however, refunds will not be granted due to game updates or content changes.
- Pre-orders: Cancellation before the release date is possible with a full refund.
- Digital assets (asset/template/plugin): A refund may be requested within 14 days provided the asset has not been downloaded. Once downloaded, refunds for digital assets may be limited.
Refund eligibility may depend on usage time, consumption, and other factors at the Company's discretion.
5. Non-Refundable Situations
- You provided the "waiver of right of withdrawal" consent at purchase and downloaded/launched the content.
- Games played for more than 2 hours.
- Digital assets that have been downloaded and/or integrated into projects.
- Gift codes (once redeemed).
- Requests from accounts suspended for violation of the Terms.
- Price drops during promotional/sale periods (no price matching).
6. Refund Process
To submit a refund request:
- Use the refund link in your Lemon Squeezy order confirmation email, or
- Send an email to info@atagames.co with your order number and reason for refund.
After receiving your request, we will evaluate and communicate our decision within 14 days. Approved refunds will be credited to the original payment method by Lemon Squeezy within 10 business days.
7. Chargebacks and Payment Disputes
Please contact us before initiating a chargeback through your bank/card company. Unjustified chargeback requests may, under Lemon Squeezy's fraud prevention policies, result in account closure and loss of access to associated content.
8. Developer Refund Liability
When a refund is approved for Developer-produced content, the commission paid to the Developer will be reversed. Developers are deemed to have accepted this policy upon joining the Platform.
9. EU Online Dispute Resolution (ODR)
Consumers residing in the EU may refer refund disputes to the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
